1. Acceptance of Terms

By accessing or using the Construction Gamma website, application, platform, or any related services (collectively, the “Platform”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, you may not access or use the Platform.

These Terms constitute a legally binding agreement between you (“User”) and Construction Gamma, LLC (“Construction Gamma,” “we,” “us,” or “our”).


2. Description of the Platform

Construction Gamma is not an artificial intelligence model, AI system, or AI service provider.

Construction Gamma provides:

  • A prompt library curated for construction professionals

  • A networking and discussion platform for industry peers

  • Tools that help Users prepare inputs (e.g., prompts, templates, workflows) for use with third-party AI platforms of their choosing

Construction Gamma does not:

  • Generate AI outputs

  • Control, operate, train, or host AI models

  • Guarantee the accuracy, completeness, or suitability of any AI-generated output produced using prompts sourced from the Platform


3. Eligibility

You must:

  • Be at least 18 years old

  • Be capable of forming a legally binding contract

  • Use the Platform for professional, lawful purposes

Construction Gamma reserves the right to verify professional or company email domains and deny or revoke access at its discretion.


4. No Professional Advice Disclaimer

All content on Construction Gamma—including prompts, discussions, templates, examples, and peer responses—is provided for informational purposes only.

Nothing on the Platform constitutes:

  • Legal advice

  • Engineering advice

  • Architectural advice

  • Financial advice

  • Safety advice

  • Scheduling, claims, or risk advice

Users are solely responsible for:

  • Reviewing all outputs generated using third-party AI tools

  • Applying independent professional judgment

  • Ensuring compliance with applicable laws, contracts, codes, safety standards, and project requirements


5. Third-Party AI Platforms

Construction Gamma is not affiliated with, endorsed by, or responsible for any third-party AI platforms, including but not limited to:

  • OpenAI

  • Anthropic

  • Google

  • Microsoft

  • xAI

  • Any other AI or LLM provider

Use of any third-party AI platform is governed by that provider’s own terms and policies. Construction Gamma disclaims all responsibility for third-party AI outputs.


6. User-Generated Content

Users may submit content including but not limited to:

  • Prompts

  • Comments

  • Replies

  • Discussions

  • Files or attachments

You retain ownership of your content but grant Construction Gamma a non-exclusive, worldwide, royalty-free license to host, display, reproduce, modify, and distribute such content solely for operating and improving the Platform.


7. Prohibited Conduct

Users agree not to:

  • Post abusive, harassing, defamatory, obscene, or hateful content

  • Engage in cyberbullying, threats, or intimidation

  • Use profanity directed at individuals or groups

  • Impersonate others or misrepresent credentials

  • Upload malicious code or attempt unauthorized access

  • Use the Platform to violate laws, contracts, or professional obligations

  • Use the Platform to provide or solicit illegal or unethical conduct

  • Scrape, copy, or redistribute proprietary prompts without authorization

Construction Gamma reserves the sole right to determine violations.


8. Content Moderation & Enforcement

Construction Gamma may, without notice:

  • Remove or edit content

  • Restrict visibility

  • Suspend or terminate accounts

  • Ban users permanently

We are not obligated to monitor content but reserve the right to do so.


9. Construction-Specific Risk Acknowledgment

You acknowledge that construction projects involve:

  • Safety risks

  • Financial exposure

  • Legal obligations

  • Schedule impacts

  • Regulatory compliance

Construction Gamma does not assume responsibility for:

  • Field execution decisions

  • Safety outcomes

  • Cost or schedule impacts

  • Contract interpretation

  • Claims, disputes, or litigation outcomes


10. Intellectual Property

All platform content excluding user-generated content—including:

  • Prompt structures

  • Prompt frameworks

  • Taxonomies

  • UI/UX design

  • Branding

  • Logos

  • Databases

Are the exclusive property of Construction Gamma and protected by intellectual property laws.

Unauthorized reproduction or redistribution is prohibited.


11. Confidentiality & Data Security

While we take reasonable measures to protect data, no system is 100% secure.

Users are responsible for:

  • Avoiding posting confidential or sensitive project data

  • Redacting identifying information

  • Complying with employer and client confidentiality obligations


12. Disclaimer of Warranties

The Platform is provided “AS IS” and “AS AVAILABLE.”

Construction Gamma disclaims all warranties, including:

  • Accuracy

  • Fitness for a particular purpose

  • Non-infringement

  • Availability

  • Error-free operation


13. Limitation of Liability

To the maximum extent permitted by law, Construction Gamma shall not be liable for:

  • Indirect or consequential damages

  • Lost profits or business interruption

  • Claims arising from AI outputs

  • User-generated content

  • Reliance on Platform content

Total liability shall not exceed the amount paid by the User (if any) in the prior twelve (12) months.


14. Indemnification

You agree to indemnify and hold harmless Construction Gamma from any claims arising out of:

  • Your use of the Platform

  • Your content

  • Your violation of these Terms

  • Your reliance on third-party AI outputs


15. Termination

We may terminate or suspend access at any time, with or without cause, without liability.


16. Governing Law & Venue

These Terms shall be governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles.

Any disputes shall be resolved exclusively in courts located in Massachusetts.


17. Modifications

We may update these Terms at any time. Continued use constitutes acceptance of the revised Terms.
